Terms and Conditions
These Terms and Conditions (hereby referred to as “T&C”) govern all Bookings made with Red Apple Apartments AB (referred to as “RAA”). Please note that for some Apartments special Terms and Conditions apply that over-ride RAA Terms and Conditions. In those cases the special Terms and Conditions will be listed on the Apartment page by the apartment owner.
By accepting these T&C you or the person you are booking on behalf of (the “Customer”) enter into a direct contractual relationship with the Apartment Owner or Supplier (hereby referred to as "AO") you intend to rent from. RAA is not a party to this agreement but is instead bringing together contracting parties in a safe and secure way through its website.
RAA's purpose is to facilitate renting of short-term apartments through its standardized agreements, bringing together contracting parties in a safe and secure way through its website. These T&C have been accepted by the AO and he/she has given RAA full authority to conclude an agreement, based on them, on his/her behalf.
To secure the Booking you must complete the online booking process. The Booking is confirmed when you have completed your payment and you receive the Booking Confirmation by email from RAA. Bookings made through phone and email are confirmed only when RAA has received a reservation payment and sent you a Booking Confirmation by email.
The person who completes the online booking form must be over 20 years of age, and at least one Customer staying in the Apartment must be over 20 years of age.
2. Obligations and Liabilities of the Customer
You will be required to show a valid credit card (Master Card or Visa only) and identification that matches the name on the credit card upon check-in and write this information in the Customer Registry Form. Failure to present the required identification may result in your booking being cancelled without a refund. In the case of fraud, the credit card you present at check-in will be charged in place of the one used to book the apartment.
The Apartment and its contents must be treated with respect. The apartment must be left in the same condition as when you checked into the apartment (except for final cleaning). Any damages to the Apartment or its contents caused by you or those staying in the Apartment must be paid in full by you. In the event that damage is discovered after you depart, the AO is entitled to invoice you for the damages if he has sufficient photographic evidence to support the claim.
The number of guests staying in the Apartment may not exceed the number of guests stated on the booking confirmation document unless specifically approved by the apartment owner. Please note that additional costs may apply. Children 2 years of age and under do not count toward the maximum number. Visitors are allowed during daytime but are not allowed to stay overnight. Any change of guests during the stay must be approved by the apartment owner prior to completing your booking.
No illegal activities and/or parties are allowed in the Apartments. Please respect Apartment neighbors. Noise should be kept to a reasonable level at all times. If a disturbance is caused to the neighbors and/or you booked the apartment for illegal activities, the AO reserves the right to cancel the booking or request that you leave the Apartment without the right to claim any type of compensation. In this case the booking will be terminated immediately and treated as a customer cancellation without any refund.
RAA may on occasion arrange viewings or photo shoots, in which case a suitable time will be agreed with the current tenant.
For monthly bookings in Denmark: Official address registration in the apartment must be requested from the AO prior to booking the apartment. If this is not done, registration approval cannot be guaranteed, and if not approved it will be treated as a client cancellation.
3. Obligations & Liabilities of the AO
The AO is directly responsible for the information presented on his/her Apartment information page on the website.
The AO is responsible for managing the Apartment and providing additional rental agreement if required by applicable national and/or local laws including those regarding health, safety and insurance.
The AO is not responsible for any direct or indirect personal or medical costs, expenses, damages and losses suffered or incurred by you and other guests before, during or after your stay in the Apartment, except to the extent to which it is unlawful to exclude such liability.
The AO cannot guarantee, or be held responsible for any failure or interruption of services to or equipment in the Apartment or disruption or noise caused as a result of repair work being carried out in another part of the property. However, upon notification, the AO will try to deal with such problems within a reasonable period of time. If the problem is of that nature that it severely affects your stay in the Apartment and the AO is unable to fix the problem within 24 hours you will be offered an alternative accommodation if an alternative is available. In extreme cases, where disputes between the AO and the tenant cannot be resolved, Client holds the right to leave the apartment, and receive a refund for the dates that he or she did not stay in the apartment.
4. Obligations & Liabilities of RAA
RAA’s responsibility is to provide a website for Booking Apartments owned by individual AOs and companies. RAA is only responsible for the functionality of the website content created by RAA. This excludes all information on apartment pages.
RAA is not responsible for any actions taken by either party of this Agreement after the Booking Confirmation has been sent.
In the unlikely event that the AO cancels the Booking, RAA cannot for obvious reasons guarantee you that particular Apartment. RAA will however, to its best abilities, attempt to provide you with a suitable replacement. In such cases you can either accept the replacement or cancel the Booking and receive a full refund of your payment. RAA cannot be held responsible for cancellations made by AO and therefore will not accept any claims for losses caused by the cancellation.
5. For Rentals of 29 nights and shorter (Nightly)
Check-in time is between 15:00 and 20:00. Check-out time is before 12:00 on the day of departure. The arrival time should be communicated to the Apartment contact person as stated in the Booking Confirmation email. Other check-in or check-out times can be negotiated with the AO, but additional fees may be charged for special requests.
The Apartment will be clean when you arrive and include fresh linen, hand soap, dishwashing liquid, toilet paper and towels. If the Apartment is not properly cleaned when you arrive, please contact the AO immediately.
a. Changes and Cancellations of Nightly bookings
If you wish to change your Booking after it has been confirmed, please contact RAA. RAA will use its best endeavours to accommodate changes to the Booking but cannot guarantee that such requests will be satisfied without costs incurred.
A cancellation link will be provided in your Booking Confirmation email. Please click on this link in order to cancel your booking. Cancellations are subject to the cancellation policy below:
For bookings that are partially paid upon booking, the amount already paid to RAA is non-refundable. Please note that the cancellation policy above does not apply to partial payment bookings.
For bookings made during Special Events periods, no refunds will be issued for cancellations made 30 days or less prior to check in. Cancellations made more than 30 days prior to check in qualify for a 50% refund. Special Events are noted in the Apartment booking page on RAA’s website.
6. For Rentals of 30 nights and longer (Monthly)
For rentals of 30 nights or longer (referred to as "monthly rentals") additional terms & conditions may apply and will be found on the Apartment information page, or in email correspondence with RAA.
To secure an apartment for rental period, the Customer is required to pay the rental amount for the first two calendar months upon booking. Thereafter the Customer will be charged 45 days in advance of each payable month.
For rentals of 30 nights or longer an additional security deposit may be required by the AO. In this case the security deposit will be marked on the apartment homepage or communicated to the client prior to booking. The security deposit payment will be made directly to the AO by the client prior to or upon check in. It will be returned to the client from the AO within 7 days after check out, as long as the apartment is left in the same condition as it was received (except final cleaning). Note that any security deposit payment is strictly between the owner and client.
a. Condition of the rented premises
When the rented premises are handed over to the tenant, they shall be in such a condition as may generally be regarded as satisfactory in terms of their intended use and their location. When the premises are handed over to the tenant, they shall be clean, the locks and electrical switches in working order, and the sanitary, heating and household appliances that are regarded as belonging to the premises, and also the water-supply and drainage systems, smoke detectors and fire extinguishers, in working order. Furthermore, the premises shall, in other respects, meet the requirements set out in legislation and regulations regarding fire prevention.
At the end of the rental period, the tenant shall return the premises to the landlord, together with their fixtures, in the same condition as when he took them over.
b. Maintenance of the rented premises
The tenant shall repair damage to the rented premises or their fixtures caused by himself, members of his household or other persons whom he permits to make use of the premises or to enter them and move about in them.
The tenant shall be obliged to see to minor maintenance, such as replacing light bulbs and the batteries in smoke-detectors, and cleaning drains, at his own expense. The landlord shall see to all other maintenance of the rented premises, both internally and externally.
The landlord shall at all times bear the cost of damage for which compensation must be paid under the conditions of ordinary houseowners’ insurance.
c. Use of the premises and access by the landlord to the rented premises
The premises may not be used in a manner other than that agreed in these T&C. The tenant shall be obliged to treat the rented premises well and keep them tidy and observe the rules set and good practice regarding hygiene and health. The tenant may not carry out modifications or make improvements to the premises or their fixtures. The landlord shall be informed without delay of things, both inside and outside the building, that need repair or maintenance.
The landlord may never enter the rented premises when the tenant or his agent is not present without first obtaining the tenant’s permission.
d. Changes and Cancellations of Monthly bookings
In case of early check-outs, the customer will be accountable to pay two calendar months: The check-out month (regardless of actual check-out date), as well as the next calendar month. In addition a payment of 10% for each remaining month is payable.
If the client is cancelling a period of 60 nights or less, the remainder of the contract will be owed prior to check out.
The same cancellation policy applies to weekly cleaning charges.
If you have a complaint about the Apartment, the cleaning of the Apartment or the Apartment surroundings you need to notify the AO directly then contact RAA if you feel your problem might warrant a refund or a discount. Refunds and discounts need to be negotiated with the AO directly. RAA will not be able to issue a refund for any portion of your stay if you do not reach an agreement with the AO. RAA does not make the payment to the AO until after you have checked into the Apartment. If something is not right at your arrival, it is very important that you contact RAA immediately.
The content of the website www.redappleapartments.com including the website design, text and graphics, all software compilations, underlying code and software is copyright of RAA or the AO. The material may not be copied, reproduced or redistributed without written permission.
RAA will endeavor to safeguard your privacy, and personal information collected will only be used to tailor and improve the services to suit your needs. Neither RAA nor the AO will sell, trade, or rent your personal information to third party companies or organizations.
The Customer agrees to indemnify RAA and the AO for the full amount of all claims, liabilities, demands, damages, expenses, losses, refunds, fines, costs (including legal costs) and all other sums of whatever nature incurred or suffered as a result of any breach of this Agreement or other unlawful or negligent conduct performed by the Customer in relation to it. If you are booking for, as or on behalf of a business or business employee, that business shall indemnify RAA and the AO. This indemnity shall survive and remain in full force and effect after the termination of this Agreement.
